What types of property can you buy-to-let in Jersey?
In general terms, buy-to-let Jersey property ownership falls into the same categories as buying residential property, namely freehold, flying freehold or share transfer property. It is also possible to buy leaseholds, but these are not common in Jersey.
Do I need residential qualifications to purchase a buy-to-let Jersey residential property?
Purchasing freehold or flying freehold Jersey residential property (save for unregulated property) requires qualification under the Control of Housing and Work (Jersey) Law 2012. In essence, if you do not qualify as Entitled or Licenced you will not be able to purchase. If you are not qualified you can purchase share transfer property as a buy-to-let but you will not be legally allowed to reside at the property.
Are there specific regulations dealing with buy-to-let Jersey property?
Jersey, akin to other well-run jurisdictions, has legislation in place to deal with residential buy-to-let property. As such, you must ensure that any property you purchase and operate conforms to the basic minimum housing standards and fire safety measures required under Jersey law. You will also need to ensure your tenancy agreements conform with the Residential Tenancy (Jersey) Law 2011 and associated legislation, such as the requirement to lodge deposits with the tenancy deposit scheme and provide a condition report.
