When Should You Appoint a Property Lawyer in Jersey? Earlier Than You Might Think

Many buyers and sellers in Jersey wait until an offer has been accepted before speaking to a property lawyer. While that may seem sensible, it can often mean valuable time is lost. Over the years, I have seen how early legal involvement can make the difference between a smooth transaction and one that becomes delayed by issues which could have been identified and addressed much sooner.

The case for early instructions

The best time to instruct a lawyer is as soon as you are seriously considering a purchase or sale.

If you are buying, that may be when you have identified a property you would like to pursue and are preparing to make an offer. If you are selling, it may be when you decide to put your property on the market or shortly after accepting an offer in principle.

In Jersey, buyers are not usually legally committed until completion of the transaction. However, that does not mean there is no benefit in starting the legal process early. The earlier your lawyer becomes involved, the more time there is to investigate title, review documentation, raise enquiries and identify any potential issues before the transaction reaches its critical stages.

Why timing matters

Early instructions allow us to begin our investigations without the pressure of an imminent completion date.

We can review the title to the property, examine Public Registry records where appropriate, review the draft contract and supporting documentation, and identify any issues that may require further investigation. We can also carry out the necessary enquiries with relevant authorities, utility providers and other parties connected with the property.

By starting these checks early, concerns can often be resolved before they become obstacles.

For freehold and flying freehold properties, completion takes place before the Royal Court. This means buyers, sellers, lenders and lawyers are usually working towards a specific court date. The earlier the legal work begins, the easier it is to ensure that title investigations, mortgage arrangements and due diligence requirements are completed in good time.

What we need from you

When you instruct us, we will normally require identification documents, details of any mortgage finance, proof of funds and information regarding the transaction itself.

For buyers, we must also comply with Jersey’s anti-money laundering and customer due diligence requirements, including verifying the source of funds being used for the purchase. These enquiries are an important part of the process and are designed to protect both clients and professionals.

Providing information at an early stage allows us to complete these checks thoroughly and efficiently, reducing the risk of avoidable delays later on.

Identifying problems before they become crises

Not all Jersey properties are the same.

Some involve flying freehold structures, while others are share transfer properties where ownership is acquired through shares in a company rather than by purchasing the property directly. Each structure has its own legal and practical considerations.

Properties may also be affected by rights of way, shared access arrangements, restrictive covenants, boundary issues or historical title matters that require investigation.

When issues are identified early, there is usually time to obtain further information, negotiate solutions, satisfy lender requirements or put appropriate protections in place.

If the same issue only comes to light shortly before the scheduled completion date, the available options can become far more limited and may even jeopardise the transaction.

The value of early advice

Many clients assume they should wait until negotiations are complete before seeking legal advice. In reality, an early conversation can often provide useful guidance on the likely process, anticipated costs, timescales and any property-specific issues that may arise.

It can also help identify matters that deserve attention before an offer is made or accepted, allowing potential problems to be managed proactively rather than reactively.

What you should do now

If you are thinking about buying or selling property in Jersey, consider speaking to a property lawyer sooner rather than later.

Whether you are purchasing a freehold house, a flying freehold apartment or a share transfer property, early legal advice can help ensure that the transaction progresses as smoothly as possible.

If you already have documents relating to the property, gather them together. If you know your proposed budget or borrowing requirements, that information is helpful too.

Most importantly, simply get in touch. An early conversation can often save considerable time, expense and stress later in the process.
